The following General Terms and Conditions of Sale govern the sale of merchandise by (the “Provider” or “we”) to you through www.alencooper.com. The Site is available for purchases made and delivered all over the world. Your use of the Site to purchase merchandise indicates your agreement to follow and to be bound by these General Terms and Conditions of Sale.
1. ORDERS & PRODUCTS
All orders are subject to email confirmation by us. Please note that the products displayed on the Site may be out-of-stock or discontinued, and in such circumstances we will special order these items in the respective size and color for the customer and inform the customer about the same for only that products that do not display 3-4 weeks delivery time on the product page. Please note that while we have tried to accurately display the colors of products, the actual colors you see will depend on your monitor and may not be accurate.
All prices are in US Dollars. Prices may change without notice from time to time. The total amount due is inclusive of sales tax applied in accordance with applicable state and local regulations based on your shipping address. The applicable sales tax amount is indicated on the payment page of the cart.
The amount of sales tax charged on your order will depend upon various factors, including type of item purchased, sales price and destination of the shipment. Sales tax regulations may change between the time you place an order and the time of credit card charge authorization and this may affect the calculation of sales taxes. The amount appearing on your payment page of the cart may differ from the sales taxes ultimately charged as indicated in the invoice you will receive with the shipping confirmation email.
All prices are inclusive of customs and import duties.
3. SHIPPING COSTS
Shipping is Free in the United States and $40 charged for International Shipping. The buyer is responsible for the shipping costs associated with all the returns.
4. SHIPMENTS AND DELIVERY
You bear all risks of loss and damage to the products from the time the same have cleared our fulfillment house. Delivery is deemed complete and title to the products passes to you upon acceptance of shipment by a common carrier.
5. RETURNS AND REFUNDS
FOR RETAIL CUSTOMERS
All returns should be made within 4 days of receipt of the product. If there is a size issue, the customer can exchange the item for a different size or style within 4 days from the date of receipt of the item. If the customer wants to return the product, all returns should be made within 4 days of receipt of the product for retail customers for the stock items. The returned product needs to be in original packaging, completely unused, unaltered and unwashed with all the price tags and proper packaging. If the return or exchange does not match with our Alen Cooper policy & regulation then we can easily reject the return as we reserve the right. In case of a return, there will be a 40% re-stocking fee for Leather Items and 50% for Fur Items. The re-stocking fee plus any shipping charges of US $25 for Domestic Orders will be deducted from the total amount paid for the item and the balance amount will be returned back in the same format as it was received within 7-10 business days.
Return Shipping charges are paid by the customer.
In case of an exchange, if we do not have the stock available then we will consider it as a special order after informing the customer by email and customize the style in the factory without any delay and will deliver the product in 3-4 weeks. In such case, if the customer do not want to special order the item, the customer can cancel the order within 24 hours of our email by sending their cancellation request to our email at [email protected]. If no cancellation is made within 24 hours, the order will be considered as a special or customized order and will be binding by all the terms and conditions related to Special or Customized Orders.
SPECIAL OR CUSTOMIZED ORDERS
ALL CUSTOMIZED OR SPECIAL ORDERS ARE NON-REFUNDABLE. WE DO NOT ACCEPT ANY RETURNS & REFUNDS OR CANCELLATIONS ON CUSTOMIZED OR SPECIAL ORDERS that needs 2-3 weeks or 3-4 weeks for Delivery which is mentioned on all the product pages. All product pages that mentions Delivery time for example – Delivery within 2-3 weeks or 3-4 weeks is to be considered as a Special or Customized Order and are Non- Refundable.
Due to the Pandemic – Covid-19, all Special Orders/ Customized Orders process might take an extra 2-3 weeks. No cancellation of orders or Refunds will be accepted.
We are not responsible for any wrong size measurements provided by the customer. All the customized orders strictly follow the size specs provided by and approved by the customer. Since this is a customized order the customer is allowed to make applicable changes in the design if he/she desires.
We offer free alterations for special or customized orders within 4 days of delivery of the item for a more perfect fit for which the customer needs to inform within 4 days from the receipt of the item. For any other concern please email us at [email protected]
ON INTERNATIONAL ORDERS ONLY EXCHANGE IS AVAILABLE. The shipping charges for back & forth would be paid by the buyer.
FOR WHOLESALE CUSTOMERS
There are no RETURNS, REFUNDS OR CANCELLATIONS ON WHOLESALE ORDERS. All wholesale orders are non-refundable.
How to enable a return
If you have bought the product from any shopping portal then if you have to follow that portal’s return scheme
Or if you have directly purchased from Alen Cooper’s site then at the first move is send us an email at [email protected] regarding your concern whether to exchange for a different style or size or color. followed by an email from us where you need to fill our Return Form. After receiving your Returned Form, we will email you the approved Return Form with the Return Address. On receiving the return form, you may then ship the item back to us.
Please note that during the peak season, the returning regime may take some adding time.
6. BINDING AGREEMENT
Our order confirmation, these General Terms and Conditions of Sale and our other Site Policies shall be deemed the final and integrated agreement between you and us on the matters contained in these General Terms and Conditions of Sale.
7. GOVERNING LAW AND CHOICE OF FORUM
The laws of the State of New Jersey (without giving effect to its conflicts of law principles) govern all matters arising out of or relating to these General Terms and Conditions of Sale, including, without limitation, their validity, interpretation, construction, performance, and enforcement. All legal proceedings arising out of or in connection with these General Terms and Conditions of Sale shall be brought solely in the City of New Jersey, State of New Jersey.
8. DISCLAIMERS AND LIMITATIONS OF LIABILITY
The provider makes no representations or warranties of any kind, express or implied, as to the products included in the www.alencooper.com site nor as to the merchandise being sold to you. To the fullest extent permissible by applicable law, the provider disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement, and there are no warranties, express or implied, which extend beyond the description of the merchandise contained on our order confirmation. The provider will not be liable for any damages of any kind arising from the use of the site, including but not limited to direct, indirect, incidental, punitive and consequential damages certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you might have additional rights.
If any provision of these General Terms and Conditions of Sale is determined to be invalid, illegal or unenforceable, the remaining provisions of these General Terms and Conditions of Sale remain in full force to the extent permitted by law.
11. FORCE MAJEURE
Provider shall not be liable for any delay or failure in performance caused by circumstances beyond its reasonable control.
12. ERRORS AND INACCURACIES
Our goal is to provide complete, accurate, and up-to-date information on our website. Unfortunately, it is not possible to ensure that any website is completely free of human or technological errors. This website may contain typographical mistakes, inaccuracies, or omissions, some of which may relate to pricing and availability, and product information. We reserve the right to correct any errors, inaccuracies or omissions, including after an order has been submitted, and to change or update information at any time without prior notice.
13. COLOR DIFFERENCE
Since this is a natural skin product there will be always be a color difference between the original picture on the website and the product you will receive. No claims, returns or refunds will be accepted due to this color variation.
14. LAYAWAY CONTRACT TERMS:
All Layaway’s are Non-Refundable. There are no Cancellations or Exchanges on Layaway Items. The undersigned is making a layaway purchase, and all payments made now or hereafter shall be applied to the unpaid balance. Seller shall retain goods until the unpaid balance is paid in full. The balance is to be paid in equal monthly installments according to the terms agreed upon. The item(s) will be returned to stock if the customer misses more than one payment unless other arrangements are made prior that are agreed upon by both parties. If this occurs, all monies paid will be credited to customer in the form of an in-store credit which must be redeemed within (90) days from the date of Store Credit issued by paying the balance in full for the Layaway Balance. If this is not done, all monies will be forfeited.
